Minister Clarifies Data Gap
Union Minister of State for Health, Anupriya Patel, told the Lok Sabha that data on medical negligence cases filed in India is not maintained at the central level. The clarification came in response to questions by MP Dr. Bachhav Shobha Dinesh, who sought state- and UT-wise figures for such cases over the last decade, along with conviction rates and the number of doctors found guilty of professional misconduct.

Health is a State Subject
Dr. Dinesh also asked if the Centre would direct states to maintain such records and compile them centrally to help reduce medical negligence. The Minister reiterated that since health is a State subject, these matters fall primarily under state jurisdiction.

Legal Framework and Disciplinary Action
Patel explained that under the National Medical Commission Act, 2019, State Medical Councils and the Ethics and Medical Registration Board can take disciplinary action for professional or ethical misconduct by registered medical practitioners. The law ensures an opportunity for the accused to be heard and allows appeals against decisions.

Ethics Oversight by NMC
The Minister said the Ethics Board of the NMC regulates doctors’ professional conduct, promotes medical ethics, and handles complaints under Clause 8.2 of the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002.

No Evidence of Bias
Addressing concerns over alleged bias in favour of doctors within the NMC, Patel told Parliament that the Health Ministry has not received any such reports.
