New Delhi: The District Consumer Disputes Redressal Commission, New Delhi, has directed a city-based hospital and its doctors to pay ₹48 lakh to a man who lost his wife due to alleged medical negligence. The commission found the hospital and its staff guilty of several lapses in handling the case.
The gynecologist was deemed unqualified to perform the surgery—Diagnostic and Operative Hysteroscopy—due to a lack of necessary skills. The hospital was held accountable for failing to maintain proper documentation, including event records, progress notes, nursing notes, and diagnostic test reports. It was also found guilty of manipulating and withholding medical records. Additionally, another doctor was implicated for unethical collaboration with the gynecologist and the hospital in falsifying medical documents.
The incident dates back to 2013, when the patient was admitted to the hospital for surgery to treat Asherman’s Syndrome using Diagnostic and Operative Hysteroscopy and D&C. During the procedure, the patient developed complications. The complainant, her husband, was informed of the complications, and shortly after, the doctors decided to transfer her to Fortis Escorts Hospital, citing their inability to manage the situation. Tragically, the patient passed away at the second hospital.
