Background of the Controversy

The Kerala High Court intervened in the ongoing controversy regarding the transfer of medical officers at the Kozhikode District Medical Officer (DMO) office. The issue began when the current DMO, N. Rajendran, refused to relinquish his position to Dr. Asha Devi, who had been transferred to Kozhikode from Ernakulam. Rajendran challenged the transfer order in the Kerala Administrative Tribunal (KAT), leading to a series of developments.

Escalating Tensions

Despite Dr. Asha Devi officially assuming charge on December 10, Rajendran continued to hold office, citing a favorable order from the KAT. Dr. Asha Devi’s return from leave on December 23 saw Rajendran still in his position. In an unusual turn of events, she chose to sit in front of him, highlighting the tense standoff.

High Court Intervention

Justice Kauser Edappagath of the Kerala High Court directed authorities to maintain the status quo prior to the controversial transfer. The court emphasized that the KAT had directed the health department to hear grievances from the affected officers regarding the transfer and issue fresh directions within a month. The court also criticized the Health Department for proceeding with the transfer order despite the KAT’s instructions.

KAT’s Decision

The KAT had previously stated that the December 9 transfer order violated principles of natural justice. It ruled that all affected parties should be given the opportunity to present their claims before new decisions are made. The KAT’s order also indicated that not all transferred employees had sought intervention, which led to the Health Department’s additional order for compliance with the transfer. However, the court found the Health Department’s actions to be in disregard of the KAT’s directive.
