Doctors allege violation of service rules, question continuation in administrative post after 62 years

The Bombay High Court recently heard a petition challenging the continued tenure of the dean of Goa Dental College and Hospital, with allegations that she has been holding the administrative post “illegally” beyond the prescribed retirement age of 62.

Petition Filed by Doctors Raises Rule Violation Concerns

According to reports, a group of doctors from the institution approached the court, claiming that the dean, who turned 65 this month, has continued in her role in violation of the Fundamental Rules and the Goa State Civil Service (Retirement) Rules, 2000.

The petitioners have sought directions to the state government to discontinue her services, arguing that her continuation as dean is not legally sustainable.

‘Dean-Professor Emeritus’ Redesignation Under Scrutiny

The plea also questions an order dated May 27, 2020, which reportedly redesignated the post as “dean-professor emeritus.” Petitioners argue that this change was never approved by the personnel department, nor were the recruitment rules formally amended to accommodate such a position.

They further alleged that the dean herself initiated a proposal to amend the rules after the petition was filed, suggesting a conflict of interest aimed at legitimizing her extended tenure.

Administrative vs Teaching Role Debate

As per existing rules, a teaching medical officer holding an administrative position must retire at the age of 62. While doctors are allowed to continue in teaching roles up to 65 through fresh appointments, they are not permitted to hold administrative posts beyond the retirement age.

The petitioners emphasized that the role of dean is primarily administrative, involving key managerial responsibilities. Therefore, they argue, the doctor should have stepped down from the position at 62, even if she wished to continue as a faculty member.

Concerns Over Career Progression and Fairness

The plea also highlights broader implications, warning that allowing officials to continue in posts beyond retirement age could create a “domino effect.” Such practices, the petitioners argue, may limit opportunities for younger professionals and hinder their career advancement.

Additionally, the petition describes the situation as “discriminatory and partisan,” potentially affecting the morale of junior officers within the institution.

Matter Pending Before Court

The case is currently pending before the court for further hearing, and the outcome is expected to clarify the legal position regarding tenure extensions in administrative roles within government medical institutions.
