Passing judgment in a case concerning contractual MO appointments in Himachal Pradesh, the court emphasized that while being on a merit list does not guarantee employment, candidates possess a “right to fair treatment” under Article 14 of the Constitution. The court directed the Himachal Pradesh government to issue appointment letters to eligible, aggrieved candidates within eight weeks.

The litigation stems from a 2021 Himachal Pradesh government advertisement for contractual Medical Officers. After compiling a select list of candidates, the state halted the process, leaving several positions vacant. While the Himachal Pradesh High Court originally dismissed the candidates’ petitions, citing no absolute right to appointment, the Supreme Court accepted the appeals, recognizing that the cancellation lacked legitimate justification.

The Supreme Court, led by a division bench, clarified that executive discretion in recruitment is not absolute.
