Jaipur – The Jaipur Bench of the Rajasthan High Court has officially quashed a state government order from January 2026, which mandated a ₹25 lakh bank guarantee for super-specialty (DM/MCh) admissions. Justice Nupur Bhati ruled that this requirement was invalid because it was introduced after the NEET-SS results were declared, essentially “changing the rules of the game mid-way”.
The court emphasized that the policy, implemented after the admission process had already begun, violated the Doctrine of Legitimate Expectation and was arbitrary, as reported. Candidates had acted under a previous 2025 policy that did not include such a heavy financial burden.
Key Rulings and Implications
- Admissions Based on 2025 Policy: The state must process admissions according to the previous, less restrictive rules.
- Relief for Candidates: The onerous bank guarantee is cancelled, ensuring fair access for meritorious doctors.
- Administrative Caution: The judgment acts as a check on the retrospective application of policies in medical education, ensuring fairness.
- Provisional Admissions: The court ordered that candidates should be allowed to proceed with admissions even with pending documentation, protecting them from further delays.
This decision is seen as a significant win for medical professionals, enforcing transparency in state policy.
