New Delhi : The National Commission for Disputes Redressal (NCDRC) recently exonerated a Neurosurgeon and hospital from charges of medical negligence while conducting transpedicular screw fixation between vertebrae on a patient suffering from Osteoporosis. The complainant is an anesthetist and professional colleague of the neurosurgeon. The top consumer court added “In our view, the complaint was filed, simply to blame for untoward incident to get compensation. The complainant aims to turn the wheels of fortunes in his favor by demanding such immense damages.”
Referring to the MCI order which has also exonerated the neurosurgeon, NCDRC said “ The Neurosurgeon (OP-1) adopted the standard reasonable practice and also followed ethical principal to his colleague the anesthetist whose mother was operated by OP-1. We haven’t expected and are surprised that the patient’s son being an anesthetist, has raised frivolous allegation that pre anesthetic check-up was not done. We find the doctor treated the patient reasonably and there was no deficiency or negligence during the treatment.”
