Unregistered nursing homes and clinics under scrutiny as court stresses patient safety and accountability

Bihar’s healthcare system is set for tighter oversight after the Patna High Court raised serious concerns over the growing number of unregistered clinics and nursing homes operating across the state. The court has directed authorities to urgently strengthen regulation, warning that lapses in healthcare delivery will not be tolerated.

Court Emphasises Value of Human Life

A bench led by Justice Rajiv Rai observed that “every human life is precious,” underlining the need for strict compliance in healthcare services. The court made it clear that irregular or illegal medical practices pose a direct threat to public safety and must be addressed immediately.

Action Against Illegal Treatment Centre in Vaishali

The observations came during a hearing on the sealing of an unlicensed paralysis and polio treatment centre in Vaishali district. Authorities informed the court that the facility was operating without registration and lacked qualified medical personnel.

Officials have imposed a fine of ₹1 lakh and initiated legal proceedings against those responsible for running the illegal centre.

81 Illegal Nursing Homes Found in Bhojpur

During the hearing, the bench also cited a separate case in Bhojpur district, where an inquiry into a patient’s death revealed that as many as 81 nursing homes were functioning without proper authorization.

The court expressed deep concern over these findings, noting that such unregulated establishments significantly increase risks to patient safety and quality of care.

New Policy for Small Hospitals Nearing Completion

The Bihar government informed the court that a comprehensive policy to regulate hospitals with 1 to 40 beds is in its final stages. The policy is based on recommendations submitted by a committee led by Dr Rekha Jha in February 2026.

According to officials, the draft has already cleared legal review and is currently being examined by the finance department. Earlier, a temporary exemption had been granted to such hospitals under a notification issued in March 2025.

High Court Seeks Swift Implementation

The Patna High Court has directed the state health department to fast-track the finalisation of the policy and submit a progress report in the next hearing.

The bench stressed that effective regulation is critical to ensuring accountability, improving healthcare standards, and safeguarding patients across Bihar.
