
Chhatrapati Sambhajinagar: The Additional Sessions Court in Aurangabad denied anticipatory bail to Dr. Arjun Pawar, a pediatric surgeon accused of medical negligence leading to the death of a five-year-old boy during a minor operation.
Defense by Dr. Pawar
The boy underwent surgery for a genital-related disorder on April 26, 2023, but tragically passed away on May 6. Dr. Pawar argued that the police filed the complaint 205 days after the death without justification. He claimed no direct involvement in the boy’s death, as he did not own the hospital and had already provided necessary documents and CCTV footage.
Prosecution’s Stand
The prosecution opposed the bail, citing concerns that Dr. Pawar might threaten witnesses or tamper with evidence. They highlighted discrepancies in the medical records and alleged that crucial evidence, including CCTV footage, may have been intentionally deleted.
Court’s Decision
The court, led by Additional Sessions Judge N.M. Jamadar, deemed the discrepancies in the case significant. The judge stated that custodial interrogation was necessary to gather evidence and investigate potential tampering. The court rejected the bail application, emphasizing the possibility of the accused fleeing or interfering with the investigation.
