Hyderabad: The Telangana State Consumer Dispute Redressal Commission upheld the ruling of Karimnagar district consumer forum which had imposed Rs. 6 Lakhs compensation on account of medical negligence of a doctor accused of removing kidney during surgery for kidney stones.
The fact of the case are that the patient Boosa Mallaiah in Karimnagar district approached Seva Sankalp Kidney hospital with severe stomach pain and after medical tests the doctor told that he had kidney stones which had to be removed by surgery. The patient was operated for removal of kidney stones but post-surgery his wife was informed that due to complications during surgery he has been referred to NIMS, Hyderabad where he was operated again. Post surgery again he had pain in abdomen and he visited another doctor. The doctor informed him that his right kidney was missing and hence the patient filed an FIR against the doctor and Seva Sankalp Kidney hospital.
The doctor on the other hand defended and said that the patient was having a large kidney stone measuring 29mm and due to excessive bleeding during the operation there was a life threatening situation which required the removal of right kidney of the patient. The State Commission meanwhile said that the doctor failed to give adequate reply as to why nephrectomy was performed on the patient when the surgery was meant for kidney stone removal and hence held the doctor and hospital negligent and imposed Rs. 6 Lakhs as compensation.
