
Court Imposes Stringent Conditions on the Accused
Mumbai: A sessions court in Dindoshi has granted anticipatory bail to a 29-year-old hospital attendant accused of molesting a patient while she was reportedly unconscious.
The court ruled that while the allegations were serious, the investigation could proceed without taking the accused into custody, provided he complies with stringent conditions.
The incident allegedly took place on February 8, when the woman, admitted for a throat ailment, was administered medication that caused her to fall asleep. According to the complaint, she woke up to find the attendant touching her leg from her ankle to her thigh and allegedly blinking at her. Frightened, she called for a nurse and later informed her husband, who filed a police complaint.
Legal Arguments and Court’s Ruling
Advocate Shyambahadur Kanojia, representing the accused, claimed that the case was falsely registered and that his client had no such intent.
However, Additional Public Prosecutor Usha Jadhav countered that the accused acted with sexual intent, emphasizing that physical custody was necessary to prevent possible witness tampering.
Judge D.G. Dhoble observed that the allegations could be examined during the trial. The court noted that there was no need for recovery or discovery of evidence, and since the accused was willing to cooperate, immediate arrest was not warranted.
The anticipatory bail was granted under the condition that the accused fully complies with legal directives during the investigation.
