No medical negligence but still Madras HC orders Rs 5 lakhs compensation

MADURAI : Madras high court has directed the state government to pay Rs 5 lakh compensation to a man for the death of his son in Madurai district in 2012. The court was hearing the petition filed by M Ramamoorthy before HC Madurai bench in 2012 whose son was diagnosed with Hirschsprung disease and was treated at Government Rajaji Hospital (GRH) in 2008. However, M Ramamoorthy son passed away in 2012, following which he filed the present petition seeking compensation alleging medical negligence. Justice R Vijayakumar observed that based on the documents and records, the court has concluded that there was no medical negligence on the part of the doctors who treated the petitioner’s son.

However, taking into account that the boy underwent treatment at GRH from August 2008 to April 2012, the judge said that liability could be fastened on the state government. Hence the judge directed the government to pay a compensation of `5lakh to the petitioner within 12 weeks.
